在宅基地“三权分置”改革中,应将明确宅基地资格权的法律内涵置于首要位置。宅基地资格权性质廓清的前提在于理解农民与集体所有土地之间的总有关系。总有关系呈现出清晰的团体法脉络,成员权产生于团体内部关系中,与团体性密切相关,我国集体成员权解决的正是集体所有权主体内部成员个体与整体的关系问题,应将成员权理论纳入集体所有权关系中考察。将宅基地资格权定性为成员权有利于完善我国集体成员权利体系、明确“宅基地使用权”的权利属性以及宅基地流转权能的实现等。宅基地资格权的实现应从明确宅基地的分配主体、建立合理的宅基地退出制度、建立健全宅基地资格权登记制度等三个方面展开。
In the reform of “separation of three rights” of homestead,clarifying the legal connotation of homestead qualification right should be placed in the first place.The premise of clarifying the nature of homestead qualification right is to understand the total relationship between farmers and collectively owned land.The total relationship presents a clear context of group law.The member right originates from the internal relationship of the group and is closely related to the group nature.What China’s collective member right solves is the relationship between the individual and the whole within the collective ownership subject,which should be investigated in the collective ownership relationship with the member right theory.Defining the qualification right of homestead as member right is conducive to improving China''s collective member right system,clarifying the right attribute of “homestead use right”,the realization of homestead transfer power and so on.The realization path of homestead qualification right should be constructed from three aspects:clarifying the distribution subject of homestead,establishing a reasonable homestead exit system,and establishing and perfecting the homestead qualification right registration system.
