台湾地区智慧财产法院正式设立并开始运作两年来,提高了智慧财产案件审判的专业性及效率。其有关智慧财产权民事案件的管辖、技术审查官意见的公开与否、秘密保持命令的规定是否需要修正,以及智慧财产的刑事诉讼程序等方面的得失与经验,对于我国大陆地区知识产权案件"三审合一"和建立知识产权上诉法院的探索工作不无裨益。
Since the establishment and operation of Taiwan’s intellectual property court over the past two years,the pro-fessional efficiency of intellectual property trial has improved.Its relevant experiences,such as those re the jurisdiction of in-tellectual property civil case,disclosure / non-disclosure of technical examination official’s opinion,revision of secret-keeping orders and criminal procedure of intellectual property,will benefit the traditional "three-in-one" trial system and the establish-ment of intellectual property appeal court in Mainland China.
