《食品安全法》对较多违法行为作了给予警告,拒不改正的处以罚款的规定。然而对当事人同一违法行为在警告改正后再犯是否可以罚款?或是需要重启警告程序?笔者认为,对当事人的同一违法行为在警告改正后再犯的,应当依照法律的相关规定予以罚款的行政处罚,不必重启警告程序。
Food Safety Law has stipulated that imposing fines if some one refusing to make corrections after giving warning.However,whether the penalty should be imposed directly to the person whose illegal activities had been corrected but violated the same again or a warning procedure should be restarted?As for the opinion of the author,when the person concerned has breached the same provision of the law,penalty should be imposed according to related laws and regulations without restarting any warning procedure.
